Blue, discerning alignments with Sense Motive is an Epic usage of the Sense Motive skill, and as far as I'm aware we're ECL14, which is sub-epic....

Correct. I discussed it with Makenshi and we've come tot he conclusion that those are higher task DCs available to whom can reach them. You can, say, apply the -20 penalty to gather infos without raising suspicion if you try your luck, which can well be accomplished by a ECL14 character.
Mostly, it's because they don't have any level requirements to attempt, unlike the epic feats.
